1. Services Provided

 

 

Amaro & Ink provides custom cocktail recipe development, menu design, and consulting services for bars, restaurants, and hospitality businesses. Services may include original cocktail and mocktail recipes, seasonal menu updates, and creative consultation.

 

 

 

2. Intellectual Property

 

 

  • All recipes, menus, images, and creative materials provided by Amaro & Ink remain the intellectual property of the Company unless otherwise agreed in writing.

  • Clients are granted a non-exclusive license to use materials internally within their business.

  • Materials may not be resold, published, or redistributed without prior written consent.

 

 

 

 

3. Client Responsibilities

 

 

  • Clients must ensure all recipes and ingredients comply with local alcohol, health, and safety regulations.

  • Amaro & Ink is not responsible for how recipes are prepared, served, or marketed once delivered.

  • Clients agree to provide accurate information (via questionnaires or consultation) to ensure recipes align with their brand and menu.

 

 

 

 

4. Payment Terms

 

 

  • Services are billed either as a one-time payment or on a monthly subscription basis, as agreed prior to engagement.

  • All invoices must be paid in full by the due date.

  • Deposits (if applicable) are non-refundable.

  • Late payments may result in suspension of services and/or additional fees.

 

 

 

 

5. Refunds & Adjustments

 

 

  • Due to the custom and creative nature of our work, all sales are final and non-refundable.

  • Clients may request up to two (2) recipe adjustments per month if not satisfied with the initial recipes. Adjustments may include ingredient swaps, flavor profile tweaks, or presentation changes.

  • Full menu redesigns or additional requests may incur extra fees.

 

 

 

 

6. Limitation of Liability

 

 

Amaro & Ink is not responsible for:

 

  • Any damages, illness, or injury resulting from the consumption of cocktails or mocktails created from our recipes.

  • Any business losses, loss of revenue, or reputational harm.

  • Any legal violations related to alcohol service or licensing.

 

 

Our total liability is limited to the amount paid by the client for the services provided.

 

 

 

7. Confidentiality

 

 

  • Both parties agree to keep sensitive information confidential.

  • Amaro & Ink may feature non-sensitive details (e.g., cocktail images, menu collaborations) in its portfolio or marketing materials unless the client requests otherwise in writing.

 

 

 

 

8. Marketing & Promotions

 

 

Amaro & Ink reserves the right to showcase cocktail images, recipes, or collaborations created for clients as part of its promotional materials unless the client explicitly opts out.

 

 

 

9. Governing Law

 

 

These Terms & Conditions are governed by the laws of the State of California, without regard to conflict of law principles.

 

 

 

10. Changes to Terms

 

 

Amaro & Ink reserves the right to update or revise these Terms & Conditions at any time. Updates will be posted with a revised “Last Updated” date.
